APPROVAL OF TERMS

In order to benefit from this site, fundraisers, donors, charitable organizations and everyone involved directly or indirectly with our services (herein after referred to as “users”) via this website, are required to agree to our terms of service as stated herein. The details herein is considered in expression as an agreement between the user and Giveyourbit.com (herein after represented with the terms “we”, “our” and “us”). ANY USE OF THIS WEBSITE CONSTITUTES AN ACCEPTANCE AND A COVENANT WITH THE TERMS SET FORTH. Please endeavour to read the details carefully before using this website and please DO NOT USE THIS WEBSITE IF YOU DO NOT AGREE TO THE TERMS as your use of the website would be considered an indication of your consent.

Giveyourbit is a for-profit organization located in Lagos, Nigeria.
OUR SERVICE
Giveyourbit offers a platform to individuals and charitable organization to solicit for donations towards a humanitarian cause. A dedicated page is created for all fundraisers who are able to enter their story and upload pictures and videos relating to the cause they set up the fundraiser to achieve. They are also able to monitor and receive all donations made towards their cause. Donors are able to use a debit or credit card, or use a simple method of dialling the “Star Triple Seven Hash” code on their mobile devices to make donations. Visitors are able to search through the different causes and can decide to support which ever one suits their benevolence.
RULES
As you navigate through the Giveyourbit website, there may be a number of additional rules or guidelines that may be included from time to time (herein after referred to as “the rules”) with regards to our services, site features and particular media types. Any of such rules mentioned in any area of the Giveyourbit website is hereby integrated as part of the agreement.
REVISION OF TERMS
Changes, amendments, additions and removals may be made on any part of the agreement at any time and at our will. Any of such revision as may be made from time to time shall be constituted within our rights. Users therefore are advised to occasionally review the detail of this agreement as continued use of the website shall indicate your requisite consent to all such revisions. All revisions made to the agreement shall take effect immediately they are reflected on the website. Giveyourbit relies on several partners and associates in order to offer effective services and the services provided by these partners and associates may present additional or diverse terms, it is advisable to refer to such terms before using such services. This advice may also apply to the use of our media.
Our partners include but are not limited to GSM telecom carriers; Airtel, Etisalat, Glo and MTN. These carriers provide a billing service platform and make it possible for you to donate by simply dialling a USSD string on your mobile device. All donations made by dialling the dedicated string on any of the carrier networks is indication of your agreement to the terms and revised terms as set forth by the individual carriers. It is therefore advisable to review the terms which are available to you through the following links: Airtel (www), Etisalat (www), Glo (www) and MTN (www).***
WEBSITE ACCESSIBILITY
Without notification, a service, feature, material or media content existing on the website may be withdrawn or superseded anytime at our will; Giveyourbit is under no obligation to apprise users.
USER ADMISSIBILITY
Giveyourbit reserves the exclusive right to terminate the privilege of anyone to use the website if it is determined that submitted information is incorrect, incomplete, inaccurate or obsolete, if user is below the age of 18 and have not obtained parental consent to use the website and if the use of the website infringes on any pertinent laws or legal guidelines.
GIVEYOURBIT SERVICES
Users of the website warrant that Giveyourbit on their behalf should provide such services as:
(1) Carry out medical diagnoses on the beneficiary to confirm credibility of the fundraising cause
(2) Receive and process all debit or credit card donations and all airtime donations made by individuals through their mobile network providers by dialling the dedicate USSD string on their mobile devices.
(3) Hold the funds received through the card processor and through the mobile network provider in an escrow account.
(4) Release funds to the beneficiary of the fundraiser or to the health provider or institution related to the case (depending on the situation) by cheque or by a chosen method after deduction of 8% + N5.00 service charge (the service charge will include network applicable billing charges, bank charges and medical diagnoses/validation of case).
(5) Conform to the Giveyourbit Privacy Policy
(6) Assess all fundraising applications to confirm adequate compliance with admissible requirements
(7) Confirm receipts of donations by SMS and/or email. The requisite 8% + N5.00 service charge is subject to change at any time at the exclusive and utter discretion of Giveyourbit, continued use of the website is indication of your understanding and consent.
Giveyourbit will release the funds (deficient of the requisite service charge) to the beneficiary 10 working days after the close of the fundraiser except in a peculiar event that early payment is necessary, in which case approval for release of the funds would be at the exclusive and utter discretion of Giveyourbit.
Also, at the exclusive and utter discretion of Giveyourbit, the service provided may change without prior notification and the cost of service and conditions for payments may likewise be changed or reviewed at any time and new payments effected upon adequate notification.
GIVEYOURBIT FUNDRAISING USER ACCOUNTS
Intending users of the Giveyourbit platform are required to sign up for a private account. Only users with accounts are able to raise funds for a cause. In signing up, intending users are expected to complete all required fields on the corresponding registration forms on the website and agree that all submitted information is correct, complete, accurate and not obsolete. And to avoid the submitted information becoming obsolete, agree to update the information periodically or as required.
Giveyourbit reserves the right to terminate an account if it is determined that submitted information for the account, including name, email address and other personal classifiable information is impersonated. Giveyourbit also reserves the right to decline or disapprove an account at any time or terminate an existing account without notification except a notice is required by law. Liability for loss or damage due to a termination or disapproval of account will not be borne by Giveyourbit.
Email notifications may be sent periodically to you by us or by third parties on our behalf to keep you updated on relevant information regarding your use of the website and related Giveyourbit and third party services. You may wish to opt out from receiving these emails and can do so directly on the email received, however, opting out from receiving further emails does not negate the fact that you will be held accountable for all information provided through these emails.
Giveyourbit will not be accountable for any unauthorized disclosure of your password, username or activities within your user account relating to your fundraiser as you are required to keep your account strictly private and refrain from infringing in the privacy of another person’s account. Your password particularly must not be shared with anyone else. You are also not allowed to create more than one or multiple accounts on the website as doing so is illegal and totally forbidden. It is your responsibility to ensure that you log out confirmedly from your account every time you use the website and that you safeguard your account from others. You consent to immediately report any unauthorized use of your account to Giveyourbit.
FUNDRAISING SPECIFIC TERMS AND REQUIREMENTS
As a fundraiser, an individual or organization with a user account is subject to specific terms and requirements supplementary to the terms and covenant herein. Clicking “Setup a Fundraiser” is indication of recognition and consent to these specific terms and requirements:
(1) You are a Nigerian.
(2) You are 18 years or older.
(3) You obtained parental consent to use the website or are under parental control if you are below the age of 18.
(4) You submit information that is correct, complete, accurate and up-to-date.
(5) You update your information periodically or as required.
(6) The cause for your fundraiser is genuine and well within applicable laws of the state and the federation.
(7) The funds raised will be used particularly and exclusively for the cause as stated on the website.
(8) You should be tracked down as a criminal if the funds raised are used for any other purpose aside from the one stated on the website no matter the condition involved.
(9) You will endeavour to send a thank you message on your dedicated page to all who have supported your fundraising cause

(f) If you are a non-profit organization you: (i) have tax-exempt status under section 501(c)3 of the Internal Revenue Code; and (ii) are registered with the Guidestar data base.
Furthermore, as a user of the website, you permit Giveyourbit to investigate the admissibility of your fundraiser and consent to making available additional personal or organizational information on request in order to be allowed continued use of the Giveyourbit platform.
DONATION SPECIFIC TERMS AND REQUIREMENTS
As a donor, an individual or organization with a user account is subject to specific terms and requirements supplementary to the terms and covenant herein. Clicking “Donate Now” is indication of recognition and consent to these specific terms and requirements:
(1) You are a Nigerian.
(2) You are 18 years or older.
(3) You obtained parental consent to use the website or are under parental control if you are below the age of 18.
(4) You submit information that is correct, complete, accurate and up-to-date
(5) You update your information periodically or as required.
(6) All donations are made within applicable laws.
(7) Giveyourbit will not be held accountable for losses or damages due to non-compliance with applicable laws.
(8) Although Giveyourbit investigates fundraisers equitably for admissibility with our service requirements, we do not validate, sanction or regulate any of the information on the website.
(9) You consent that using the Giveyourbit website and depending on the resources available on the website is strictly at your own risk.
USER APPEARANCE
As a user of the website, you submit, avow, indicate and certify that:
(1) You are not under the age of 13. IF YOU ARE UNDER THE AGE OF 13, PLEASE DESIST FROM USING THIS WEBSITE
(2) You essentially possess the right, authority and requisite permission to use this website and /or have the necessary licenses, rights, consents, and permissions to use and permits Giveyourbit to use all exclusive rights in and to all patents, trademarks, copyrights or other materials to allow insertion or use of the User Entries as intended by Giveyourbit and the terms herein.
(3) You essentially possess the right, authority and requisite permission from the respective and distinguishable persons in the User Entry to use the name or any form of representation of the respective and distinguishable persons to allow insertion or use of the User Entries as intended by Giveyourbit and the terms herein.
(4) You will not enter a material subject to third party proprietary, privacy or publicity rights, or a material protected by trade secret without authority from the copyright holder unless you own such rights to post, distribute or issue license rights to Giveyourbit as allowed herein.
(5) You will not broadcast lies or falsify information that could destroy Giveyourbit or any third party.
(6) You will not enter a material that is inappropriate, in violation of the law, in support of public unrest or that will inspire criminal behaviour.
(7) You will not enter information and/or material that is slandering, deceptive, incorrect, frightening, annoying, intolerable or ethnically/religiously unpleasant.
(8) You will not distribute chain letters soliciting for business or proposing any form of pyramid scheme.
(9) You will not post advertisements, marketing materials or spam.
(10) You will not collect information about users or harvest their email addresses without their permission.
(11) You will not impersonate or misrepresent another person or organization.
You realise that you will be open to a variety of User Entries from diverse sources while using the Giveyourbit website, however, Giveyourbit is under no obligation to account for the security, efficacy, correctness or the proprietary, privacy or publicity rights concerning such User Entries. In addition, you realise and accept that you may be open to User Entries that are, deceptive, incorrect, frightening, annoying or intolerable and you accept to discount and do hereby discount any lawful or justifiable constitutional rights you have or may have against Giveyourbit, and you accept to indemnify and to the utmost extent permissible by law hold Giveyourbit, its owners, staffs, affiliates and/or licensors blameless in all matters relating to your use of the website.
